How to have a good divorce

It is Resolution’s Good Divorce Week. It’s a reminder to Resolution members about the importance of dealing with family matters constructively, putting the needs of the family first.

As a long-term member of Resolution, The Family Law Company is keen to raise awareness of how people can approach divorce to avoid bitterness and anger that is too often the result of a marriage break up.

Joint MD, Rachel Buckley explained: “Choosing to divorce is rarely an easy decision. In fact, it’s cited as one of the top five stressful life events. However, if it’s handled well, the stress can be significantly reduced, and the outcome made far more positive for all concerned.”

She highlights recent client feedback as an indicator of how divorce can lead to a positive outcome for both parties: We are very grateful that Rachel followed the instructions as it was imperative for me to divorce amicably which we have done. My former husband and I still remain friends. We are both very grateful that we were able to divorce without causing one another any additional stress or financial worries. I feel very much at peace now and can move on with my life.

Whilst some still follow the traditional route to divorce, with each party using a separate lawyer, Rachel points to the ‘one lawyer, two clients’ option, which she has been championing as an alternative option after training earlier this year with Resolution.

“The established model often sees each lawyer focused solely on their own client’s interests, which can drive up costs, increase anxiety, and encourage unnecessary conflict.

“Having the same lawyer is a far more cooperative approach. It promotes resolving financial matters whilst still ensuring a fair division of assets, minimising legal costs, reducing the potential for acrimony and avoiding going to court. And with court backlogs leading to lengthy, anxious waits, the latter is a real benefit.”  

Although some couples negotiate financial terms between themselves, for most it is still helpful to have experienced legal support as there are usually assets like the family home and pensions to take into consideration. Legal guidance helps ensure fairness. When there are children of a minor age, it is always better if contact arrangements are agreed without having to go to court, which a lawyer can help with.

Rachel points out that there are other non-court options too, including mediation, arbitration and a private Financial Dispute Resolution hearing. “A dedicated family lawyer will explain what routes you can follow, after considering your individual situation and help you to find the best way forward.”

Choosing a lawyer who is a member of Resolution will help ensure that many more couples can have a ‘Good Divorce’, which offers the best outcome for everyone.
