Married couples are permitted to claim financial provision including maintenance, lump sums, pension sharing and adjustment of shares in marital property. The Courts will take into account factors such as health, ages, needs, incomes and the duration of the relationship.

Unmarried couples are permitted to make applications for orders concerning property they own jointly (e.g. orders for sale and division of the proceeds) or property owned by one party where the other has made some contribution to it. The factors listed above for married couples are not taken into account for claims between unmarried couples, but rather what they actually agreed between themselves.
