Only those with parental responsibility have the legal right to make decisions about their children. If you are a father and not named on the birth certificate you will need to obtain parental responsibility either by getting the consent of the mother or obtaining a Court order. The Court will consider all the circumstances of the case to include the attachment between the parent and child as well as the reasons behind the application. It is only in very exceptional cases that the Court is likely to refuse an application. Our experienced Children Law solicitors understand the processes well – we will advise you appropriately and with empathy.
