All too often, solicitors will generate more and more fear in a separation. This may be because they are acting in the best interests of their client, or they might be covering their own backs. Either way, working this way is negative, and creates a culture of litigation:

While this may, and we mean may, be acceptable in some legal sectors, family problems are different.

When a family goes through problems, there is always fracture, hurt and fear.

People have their own tribes; friends, family, people down the pub, their solicitor, who all feed into the fear and justification of behaviour.

Rather than help couples towards resolution, the litigation process propels them into polarisation.

The legal system is inclined to make things black and white, good and bad, right and wrong. This doesn’t fit ‘family’ at all. Families require help to resolve their situation. Often it is like untangling spaghetti.

As a family lawyer of many years standing, it has always been my aim to change the culture of family law from one of blame to one of resolution.

It is my overarching belief that wherever children are involved, they must be put right at the centre of the process.

If we can change the underlying ethos of family law then many more families will be able to settle their differences without resorting to accusation and anger.
